This Regulation establishes a European Maritime Safety Agency (EFSA) for the purpose of ensuring a high, uniform and effective level of maritime safety and prevention of pollution by ships within the European Community. This Agency shall provide the Member States of the European Union (EU) and the European Commission with the technical and scientific assistance needed and with a high level of expertise, in order to help them to apply Community legislation properly in the field of maritime safety and prevention of pollution by ships, to monitor its implementation and to evaluate the effectiveness of the measures in place.

The draft law was adopted by the European Commission on 7 December 2000 as part of the ERIKA 2 legislative package. It arose from the need to ensure the proper and uniform application of Community legislation across the EU, and the intention was first announced in the Commission's Communication on the safety of the seaborne oil trade. The principle was reaffirmed in the Commission's report ahead of the European Council summit held in Biarritz (France). The European Parliament adopted a position on 14 June 2001, followed by the Council of the European Union on 6 March 2002. A compromise text was endorsed by the Parliament on 12 June, and by the Council on 25 June. The Act was signed by the co-legislators on 27 June 2002 and published in the Official Journal on 5 August 2002.
