Summary: Regulation (EU) 2016/1624 - adopted by the European Union in September 2016 - which sets out the general principles of a European integrated border management, including the establishment of a European Border and Coast Guard (EBCG) and a European Border and Coast Guard Agency (built from Frontex). Further information: The Commission's European Agenda on Migration identified the need to move to a shared management of the external borders, in line with Article 77 (TFEU). In his annual State of the Union address, the President of the European Commission announced steps in this respect before the end of the year in the form of a fully operational European Border and Coast Guard, as was subsequently confirmed in the annual Commission Work Programme. The proposal was adopted by the European Commission on 15 December 2015, as part of a legislative package on border management. The European Council urged the co-legislators in February 2016 to agree on the content of the proposal by mid-2016. The European Parliament adopted its negotiating position on 30 May, while the Council adopted its general approach on 6 June. An informal agreement on a compromise text regarding the draft law was reached on 21 June. It was formally endorsed by the Parliament on 6 July and by the Council on 13 September. It was published in the Official Journal of the European Union three days later and entered into force on 6 October 2016. The Regulation sets up a European Border and Coast Guard, which aims to ensure the effective implementation of integrated border management at the external border of the EU as well as of the Schengen associate countries. The EBCG consists of the European Border and Coast Guard Agency, created on the basis of Frontex - the previous EU borders agency - and the EU countries's and Schengen associate countries' authorities responsible for border management. It also extends and strengthens Frontex's mandate. It amends Regulation (EU) 2016/399 and repeals Regulation (EC) No 863/2007, Council Regulation (EC) No 2007/2004 and Council Decision 2005/267/EC. |
